The E-Z Pay Bankruptcy case is proceeding as a Chapter 7
in Jacksonville, FL. Trustee Robert Altman is hard at work to locate
and protect the assets of the E-Z Pay Estate. He wrote the following
Letter to the Medical Providers, and also the following
Letter to the Patients.
Update 9/20/06:
An article on the E-Z Pay situation, "E-Z
Pay troubles," was published in the ADA News by author Arlene
Furlong.
Update 8/29/06:
We finally received the 2006 wire confirmations from Schwab showing that
ADP did in fact pay E-Z Pay as we stated, the updated link is below.
Also, a hearing has been scheduled for September 5th at 3:00 PM PDT in
the Bankruptcy Court in Nevada to determine whether E-Z Pay and Debbie
Distler sent misinformation to the Doctors about who owed them money,
etc. in violation of a prior Court Order.

Update 8/22/06: Good News--a
Chapter 11 Bankruptcy Trustee was appointed today to take over E-Z Pay.
His name is Steve Turoff of The Renaissance Consulting Group, Inc.

appears to be well qualified to sort out the truth of what has
transpired at E-Z Pay and to determine how best to proceed.
Update 8/21/06:
Due to the rumors we've heard circulating that doctors have been told by
E-Z Pay that ADP did NOT purchase contracts from E-Z Pay, we've gotten
clearance from our attorneys to post these purchase documents to help
clear things up. These were filed as a part of the Motion to Appoint
Trustee on 8/18/06. We were told that the Trustee will likely be
appointed today, great news for both the Doctors and ADP as then someone
will be able to figure out the truth of what has been going on.

Update 8/18/06: Good News--at
the hearing on 8/18/06 in the United States Bankruptcy Court in Nevada
to determine whether a Trustee should be appointed to take over E-Z
Pay's affairs, Judge Zive granted the Motion,
and a Trustee will be appointed very shortly. This is important so that
we can all find out what E-Z Pay has done with the millions of dollars
paid to them by ADP, and hopefully get the company up and running again
as well. This Motion was supported by numerous doctors via their
attorneys, as well as by ADP.

ADP E-Z Pay Doctor Letter
If you are an E-Z Pay medical provider, please
note that an
Involuntary Bankruptcy Petition was filed on August 4th, 2006 in the
Nevada Federal Bankruptcy Court against E-Z Pay by a number of doctor's
offices. It is important that your practice's name and address be added
to this list if you are owed money by E-Z Pay so that the Court can
include you in the proceedings. If your full practice name and address
DO NOT appear on the attached
Involuntary Petition Exhibit A, please send an Email to
DentistAttyForward@adpfund.com containing your
practice name, the total amount owed to you by E-Z Pay, the past-due
amount owed to you, and the ongoing monthly amount due to you; mailing
address, phone number, and Email address and it will forward to
Ms. Janet Chubb, the attorney representing some of the Dentists in the
Bankruptcy proceeding, including the Petitioning Creditors.
Also, if you have been contemplating filing an action
against E-Z Pay and/or ADP and Duvera Financial in your State's court,
please advise your attorney that this bankruptcy has been filed, and
that the appropriate venue for claims is now the United States
Bankruptcy Court in and for the District of Nevada. This will save you
from incurring legal expenses twice for the same matter, as we
understand that any actions filed in local courts will be removed to the
Bankruptcy Court where they can all be consolidated into one
proceeding.
